1. Mandatory signed agreement from both parents acknowledging the purchase of said CLIP! Both parents have the right to know when one decides to insure a child. Yes, it could get ugly if the parents disagree, but then the CSP can be used instead.
a) A child is either in the primary custody of one parent (as determined by a court) or in the joint custody of both parents (as determined by marriage or some other agreement). If there is no marriage, and no court-ordered custody arrangement, both parents have equal rights and decision-making capabilities. Depending upon the custody situation, parents already have express rights to make certain choices for/regarding their children.
b) What is supposed to happen if one parent disagrees with the purchase of a life insurance policy? Does that parent have to show-cause? Does the parent have to prove that he or she is not simply acting out of spite? Will the issue have to be presented to a judge? Will the judge have the final say? Based on what factors? Is there ANY evidence that a policy like this would stop parents who were once well-intentioned from harming or killing their children? How much more of a burden will this put on an already strained family court system?
c) Life insurance policies are not inherently harmful, and they do not typically place children at any additional risk. Most children who have life insurance policies on them DO NOT disappear. There is NO INDICATION that the life insurance policy is a central factor in this case. Before anyone came up with this proposed "Ayla's Law" did they bother to check the statistics?
2. Mandatory statement from the child’s physician stating no record of probable, suspected, or documented abuse has been noted in the child’s medical record! Having managed prominent medical offices, I can safely say this is easily done. A brief statement of fact, provided by the child’s physician will do.
a) By your own standards, Trista would not even be able to obtain life insurance on her children. Probable and suspected abuse do not meet legal standards. I can suspect anything I want, but if I want to stop someone from doing something based on such a suspicion, there better be a preponderance of the evidence to back me up. Even if documented abuse has been noted in a child's medical record, does that render the child uninsurable for the duration of his or her life? What about cases of neglect? Emotional abuse? Verbal abuse? Sexual abuse? Each of those things are notoriously unreported and difficult to substantiate.
b)While you can say this is easily done, the fact is that people doctor shop, and people will play the system. There is NO database of medical records that is accessible to doctors nationwide, and there is no central database of DHHS or CPS cases. So if I know I have abused my child and doctors in Florida have noted such abuse, what would stop me from going to another state or city to get a clean report? Nothing.
c) What if a doctor disagrees with the purchase of a life insurance policy for a child, and simply refuses to give a statement? Can he or she be compelled to do so? In Texas, a doctor can disagree with a mother getting a 3D ultrasound (ultrasounds are not harmful). If the doctor refuses to sign a waiver allowing it, the mother is not supposed to get one. Just an example, but it goes to show that doctors can and do refuse to allow things because of their own personal beliefs--even if they have nothing to do with science or medicine.
In short, your proposed mandatory requirements are not well thought out, nor do they address any real problems. Without knowing how much of a role Ayla's insurance policy played in this case, all of this is premature anyway. Money talks and bullshit walks. If your suggestions will cost ANY agency or sector involved even one red cent, you can be prepared to meet opposition that will likely be insurmountable by someone like yourself (who clearly lacks formal education or intelligence). STOP USING AYLA'S NAME TO PROMOTE AND FURTHER YOUR OWN AGENDAS. You all are pissed off that the life insurance policy was sold to Justin by his friend, so all of these attacks on the insurance industry are ill-founded.
My best advice would be to contact an attorney or child advocacy group and see if this is the real issue that should be addressed. You guys are on the road to nowhere, and you're getting there quite fast!

Why did Trista leave Ayla with Justin after he broke her arm? Accidental or not, Justin broke her arm. Even if the dr didnt report it as abuse, I would think Trista could have called dhhs herself, report the broken arm and demand they return Ayla to her? Did Trista do that? We can't know what dhhs says, but the police could sure look at all those "phones" Trista had available to her.

Why is Jessica? I'm betting she is "missing" not because she has Ayla, but because she has information about Ayla, and the family feels she will cave under pressure.
Trista needs to be re-questioned too. She claims in her faux interview that Justin used to tell her everything.
Oh yeah Trista? Prove it. Tell us something that Justin told you in private. Anything. Let's see if Justin backs it up. If they were having an affair, and were so close up til the time Trista went to detox (she did not go to rehab so I'm doubting the whole Trista is clean bs) she should be able to give us some information about what was going on in Justin's life at that time.
They leaked she had an affair. Blood on Justin's sheets. Justin was in Portland on the fifteenth of Dec. Where Trista was. Did they meet that night and he didn't have time to wash the sheets?

DeleteI just want to say that Justin and his family and friends really do not have DHHS connections. I know they were all abuzz with those "findings" but it's totally inaccurate. It is not true and one should really be certain of the facts before making statements like that. It propels ideas forward that aren't true. These ideas become the basis of public opinion and that has been the crux of the problem since the very first day Ayla was reported missing.
DeleteBut otherwise I think there are some important questions there. Many people wonder the same things. If Trista actually felt Justin was abusive why did she continue to leave Ayla with him? I really wish people would go back to her very first tv appearances and see that Trista emphatically said she felt certain that Justin would never hurt Ayla. If she was involved is it possible that she first didn't have it in her to make Justin look like a monster knowing he isn't? She then sent texts that were incredibly apologetic about the rap he was getting, and laments that she can't control what her family is saying. In addition she is, early on, still quite interested in having Justin understand her, and her personal history. By early on I mean after Ayla is reported missing but before they abruptly turned with the tide of public sentiment. Some say it was the Reynolds alone who began that swell of lynch mob mentality against Justin but they were less the initiators of that. It was the media (HLN) and the statement analysis people in conjunction with the restless public who were feeding off one another. Shortly thereafter the Reynolds and Hansons joined that chorus. The way it appeared was that when it wasn't going to fly that it was a stranger abduction because LE wasn't seeming on board with it, that they went the other direction swiftly. Tristas comments really changed suddenly to reflect what the public was saying. Hard to tell if this was a tactic on her part. If you look at all of her statements, all of her actions, and all of her text messages (leaving none of the above out), it is hard to see it all as anything but a sick game.
Yes... where is that aunt who was so angry and who did not ever want to hand Ayla over to the father in the first place? Where is that Aunt who had her own children forceably removed by the state? Where is that aunt who was seemingly attached to Trista at the hip for better or worse, whether partying, getting "messed up", or landing fisted blows upon one another? Where indeed.

I mean she was the one who had a long history with DHHS. She also was an alcoholic and drug addict. Both things I would find to be very questionable if I were told I had to question someones mental stability before selling them a LIP.
ReplyDeleteI believe there should be mandatory protocol on a federal level when a child goes missing. Certain steps should always be followed, rather than reinventing the wheel on a case by case basis. Parents and those close to the case should have to have immediate drug/alcohol testing, a polygraph, and hypnosis. There should not be a right of refusal. Also, all vehicles of close parties should be searched... presumably most small children disappear with someone in a car, not on foot. Before the community/city/state/country spends enormous effort, time, money, emotion on an investigation those issues should be cleared up with the parents/family immediately. IMO
ReplyDeleteHypnosis? You might as well suggest LSD as a truth serum. Hypnosis doesn't work. Well I take that back it possiblily can work somewhat on individuals that are can be easily influenced or are highly suggestable. And even then it is not in any way have any empirical validity.

I'm feeling anything that has a chance of working, anon. Is it less reliable than polygraph? Perhaps they could be used in conjunction. Perhaps not admissible in court, but can be used as a guide? Just thoughts derived from this case and conversations I've had. I find it surprising that some things are considered a violation of a person's rights and aren't mandated. Further, why would any involved person refuse? For example, like in this case, the people involved in Ayla's life set up (or didn't) a polygraph when they felt like it. In the meantime, there's hundreds of people searching, and there's divers in the water in the middle of winter. Now it's nearing six months since Ayla disappeared. I have to wonder if a more stringent protocol was in place if this case would have been solved by now. I wonder, also, if such aggressive measures could contribute to even one less baby disappearing in the future.
DeleteReally, I agree about protocol. Trista should have been pulled over by MSP. There was more than enough time for Ayla to be dropped off somewhere before she got to WPD. I would bet that as soon as Jessica had the chance she called Trista. Jessica knew that LE was looking for AYLA at 10:00 am.Jessica's phone should have been confiscated...Tristas phone...They should have been treated the same as my family was treated!! IT wasnt done that way! LE dropped the ball early on in this investigation. LE SCREWED UP. I have no qualms about stating that fact to the world.They didnt have a clue what they were doing! LE is the reason AYLA is not home now.That is my belief and Ill not sway from it one bit.They know they screwed up. Delete"Geeze" - it was reported that Jessica didn't contact Trista, that she wasn't reached until Ron Sr. got her on the phone around 1130. Selena is suggesting that Jessica did reach Trista, or tried to. So, geeze, you are actually agreeing with Selena.
