*This is a lengthy post, and it is not my intention to bash anyone. I have provided links, feel free to click on them!*
I know some of you are under the impression that law enforcement has explicitly said that an abduction did not occur. That's simply not true; Stephen McCausland has said:
"Abduction is no longer a part of this investigation. We have grave doubts that an abduction took place and there is no evidence to support it," Stephen McCausland, spokesman for Maine Department of Public Safety, told Newscenter 5.
“We’ve followed every conceivable piece of evidence that would follow their version of events, and we have found not one piece of evidence that supports an abduction,’’ he said.
“There were three adults in the home, and their version of events is not backed up by any forensic evidence that we have located,” McCausland said Saturday afternoon. “That someone slipped into the home in the middle of the night, while three adults are there ... that someone went into the bedroom where Ayla was sleeping alone, removed her and vanished into the night – and that the three adults did not see or hear anything – doesn’t pass the straight-face test.”
As you all know by now, I'm free to speculate as I please. In this post I want to talk about the very abduction that did not pass the official "straight-face" test. More specifically, I'm going to address the profiles of parents who abduct their children. All of the profiles can be viewed at the link, for issues of time and space, I will only discuss the most pertinent ones here.
Profile 1: When There Has Been a Prior Threat of or Actual Abduction
When a parent has made credible threats to abduct a child or has a history of hiding the child, withholding visitation, or snatching the child from the other parent, there is great distrust between the parents and a heightened risk of further custody violation.
When other risk factors are present, one or more of the following are general indicators of an imminent threat of flight with the child:
- The parent is unemployed, homeless, and without emotional or financial ties to the area.
- The parent has divulged plans to abduct the child and has the resources or the support of extended family and/or friends and underground dissident networks needed to survive in hiding.
- The parent has liquidated assets, made maximum withdrawals of funds against credit cards, or borrowed money from other sources.
Two things about this profile. Trista did not let Justin know that Ayla was his until she was 7 months old, and she did so only AFTER her fiance was sent to jail on arson charges. She even had her fiance, not Justin DiPietro, pick out Ayla's name and Ayla's umbilical cord was cut by her grandmother. One can only guess whether or not she would have let Justin know that Ayla was his if her fiance didn't end up in legal trouble. She has given conflicting accounts as to why Justin was not involved: he wanted her to have an abortion, she didn't tell him so that he wouldn't force her to have an abortion, etc. I consider this withholding visitation; you don't have to agree.

Speaking to the Daily News, Reynolds said DiPietro sent her a text message days before Ayla disappeared stating that he was worried someone might take her. She said he had made similar statements in the past.
“He always thought that I would be the one to take her,” Reynolds said. “I always wondered why he was so scared about that … I never went to get her because I thought she was okay and well cared for.”
Why would Justin have that in his head? Remember, we are only getting one side of the story. We also know that Trista is outright lying when she says she thought Ayla was okay and well cared for. She herself also talked about how Ayla would return from every visit with Justin, and something or another would be wrong with her. Instead of wondering why Justin thought that, why didn't Trista just ASK?
Profile 2: When a Parent Suspects or Believes Abuse Has Occurred and Friends and Family Members Support These Concerns
Many parents abduct their child because they believe that the other parent is abusing, molesting, or neglecting the child. These abducting parents feel that the authorities have not taken them seriously or properly investigated the allegations. Repeated allegations increase the hostility and distrust between the parents. Parents who have the fixed belief that abuse has occurred—and will continue to occur—then “rescue” the child, often with the help of supporters who concur with their beliefs, justify their actions, and often help with the abduction and concealment. In a large number of cases, the child has been previously exposed to neglectful, endangering, or violent environments (e.g., domestic violence or substance abuse). In these cases, the courts and child protective services may have failed to protect the child and the concerned parent or family member.
This doesn't even require that much added detail. You can read about abuse allegations, and Trista's threat to sue DHHS, here, here, here, here, and here. A video of Trista's 'Today Show' interview also reveals that Ayla was only placed with Justin because DHHS "violated" Trista's rights.
Profiles 3-5
Probably not applicable to this case, but check them out at the aforementioned link.
Profile 6: When Parents Feel Alienated From the Legal System and Have Family/Social Support in Another Community
Many subgroups of potential abductors feel alienated from the judicial system. Listed below are five such subgroups.
Subgroup 1. Parents who are indigent and poorly educated lack knowledge about custody and abduction laws and cannot afford the legal representation or psychological counseling that would help them resolve their disputes. Those parents who have extended family or other social, emotional, and economic support in another geographical community may be at risk for abducting their children.
Subgroup 2. Many parents cannot afford and are unaware of the need to access the court system. In addition, those who have had prior negative experiences with civil or criminal courts do not expect family courts to be responsive to their values or their plight.
Subgroup 3. Parents who belong to certain ethnic, religious, or cultural groups may hold views about childrearing that are contrary to the prevailing custody laws that emphasize gender neutrality and the rights of both parents.
Subgroup 4. A mother who has a transient, unmarried relationship with her child’s father often views the child as her property, and her extended family supports this belief. Many of the women in this subgroup assume they have sole custody of their child and are genuinely surprised when they are informed that the father—by law in California and most other States—has joint rights to the child.
Subgroup 5. Parents who are victims of domestic violence are at risk of abducting their child, especially when the courts and community have failed to take the necessary steps to protect them from abuse or to hold the abuser accountable.
In this video, Trista talks about knowing Ayla was hers and that she didn't have to share her with anybody if she didn't want to.
Common to all profiles: (1) Parent dismisses value of other parent for child, (2) child is very young or vulnerable to influence, and (3) abductor has family and social support.
Other things I found interesting about parents who abduct their children:
- Records from the Documentary Study showed that about one-fourth of the abductors did not operate alone in the act of abducting. Many abductors relied on a network of family and social support to carry out and maintain the abduction. The Interview Study found that a significant proportion of abductors (almost three-fifths of women and two-fifths of men) received moral support for their actions and practical help in planning the abduction. The network of supporters provided money, food, and lodging and was willing to conceal the whereabouts of the child.
- In the Interview Study, abducting parents frequently alleged that child protective services and family courts did not take their complaints seriously or failed to conduct a thorough investigation. (Makes me think of Trista talking about how DHHS failed to perform background checks)
This is all my own opinion as applied to a study carried out by the US Department of Justice. Please keep the comments fairly decent?!
I am looking for the link, but Steve did answer a direct question during the question and answer period where he was asked if they had ruled out an abduction and his words were "Yes I believe we stated that all the way back in the second week". Something to that effect.

Yes, why didn't Trista ever ask Justin why he felt Ayla might be taken? Maybe because she told him! This woman is too much!!!
The "straight face test" and the "smell test"? I have never heard that in any press release from police before, concerning any crime. Anyway, you can't assume something is fact because you can't find any evidence to disprove it!

This interview is important as well for the reason that Trista talks about Justin expressing fears about her snatching Ayla back. That backs up what Justin said in the texts. He was obviously reacting to the fighting that was going on over Ayla and his fears about what the Reynolds family would do. And they obviously did just that! It all came true. But no one will ever give up looking for Ayla, not ever.

Delete@ Anon "Ugh" I am referencing the confirmed liar as the person who failed the poly. By definition, a failed polygraph indicates the person is not stating what they believe to be the truth. This is not an interpretation or taking sides - anyone who fails a poly is lying (with a 99% degree of certainty).

Considering the history of Trista's knowledge of how polygraphs work, with her FIANCE having had one and all, I can't imagine why she would jump up and down to get one done. Then, ooops I can't finish it. Unless maybe Ray told her the secret to get out of one. Oh and all knowing one, maybe you can answer this for me too. When Ray fled to Panama City, FL to avoid arrest for arson was the wonderful Trista with him?

Justin met outside with his friend (ex-roomie?), and they had a very, very short conversation that was meant to be private and personal. It seems there were a few females in the same parking lot. Some of us rumors wondered if the females had the talent of lip reading. But no. No talent. One or more of the females had a 'tweety' in her ear - one of those 'as seen on TV' WalMart purchases.
The females didn't hear the question. They would have if they weren't so busy talking themselves. They only heard the answer, which was, "I smoked it."

OK. It doesn't mention that the article writer or the local CNN
interviewed Justin (and his words were gold at the time), so I
backtracked to Waterville's Morning Sentinel newspaper and searched for a possible source of the quote.
Selena, which one should I purchase? 74 matches on name, and this is the only article listed more than once (three times). Even in the summary, it says... but neither he nor the police will say how he did...' Until I find the originating source of the comment, I'm sticking to what I 'saw', what I 'heard', and what I 'felt'.

If what I keep hearing (reading) is to be believed, Justin and his family/close friends believe beyond a doubt that Trista or one of her cohorts took Ayla from the home in the middle of the night. I'm interested in what the theory is as to why, if he knows this, did he not at any point go to Trista to get Ayla back? If he was waiting for LE to do so on his behalf, and they aren't doing that for him, what is stopping him from taking a drive? And was HE so friendly with HER at the vigil? I've seen the argument about Trista not going to Waterville when she found out, so no need to repost those comments. Why hasn't Justin made any move to get Ayla? Why was he still sleeping with Trista (if that is to be believed) if he was so concerned about her taking Ayla? I think the reverse to these question has been beaten to a pulp. I just haven't seen anything explaining his actions there. I am trying to understand this piece, to help me understand why I should think Trista did this vs. Justin. And why these seem to be our only two options.

I think, that Justin decided to let LE handle the situation instead of breaking in doors… If he was after full custody, do you think he wants LE coming to get him because he is physically fighting Trista for her? DHHS is involved with this case already . Trista was forced( Yes…forced, trying to better herself my ass) to go to rehab because of a fight she had with Jessica which brought LE and DHHS into the situation to begin with.
If he was waiting for LE to do so on his behalf, and they aren't doing that for him, what is stopping him from taking a drive?

I don’t think it is the only two options. I think there are a few different options. Why not explore them? The reason Trista comes up as the answer is because if AYLA wasn’t taken by a stranger and Justin didn’t have some diabolical plan and kill AYLA sacrificially… then the scent goes straight toward Trista, her family, her lover in jail, their family or the Linnels. Take your pick. They all had a warped reason to go into that house and take a baby. Why Trista? Cause AYLA was taken. The Linnels IF they grabbed the wrong baby. Jessica and Becca….they were so pissed off at DHHS and LE they had “cause” They didn’t have to do it alone….Trista didn’t have to do this alone.
Ya know this could be as simple as Trista saying Im gonna go get AYLA and take her to see Burnboy whether Justin says I can or not. Grampy BB can you stop by the Dipietros for a minute? She may have gotten the impression from the rights and responsibility thanger that she had as much right to AYLA as Justin and who ever has her in possession has the upper hand. Her baby is in the house…shes been there…in …out…and expecting Justin to come down to S Portland or call around to find her….NOT CALL LE.
She freaked out because at that point she realizes she is in deep shit for taking AYLA in such a way that she takes her somewheres and drops her off. By the time she talks to LE she has lied so much that she cannot back out and so the story goes and the lies keep coming. Could be...Im just saying...I dont know but that is my first guess.

DeleteWell, Justin absolutely believed that *someone* in Trista's family came and took Ayla. Trista has a lot of family. who live in different places. and friends. who live in different places. And since Justin and Trista hadn't ever had a serious relationship (as stated by Trista in interviews); Justin was NOT aware of where all or even most of these individuals live. So in the midst of the chaos, when he wanted to drive straight to Portland in a blur of emotion and try to retrieve her, family friends and authorities knew better. he was told to step back, breathe, and handle this through authorities. And wholeheartedly he believed that the nightmare would come to an end as soon as they tracked who had taken Ayla and where they had taken her. Justin was not certain at any point that Trista herself had been the one to take Ayla or that Trista even knew who had. There are reasons for that- Tristas own family apparently wasn't confident in her as a mother nor did they want Ayla's father whom they didn't know to have custody of their Ayla. And he knew it. And so did Trista. For a very long time Justin held out the possibility/probability that Trista didn't know. And that answers the vigil scene that you reference. And oh.. Justin has definitely tried to find Ayla. Most definitely. But you don't live with him or talk to him, so you don't know that. and you won't believe the words you just read. Lastly, these are not our only two options. I am just telling you WHY Justin's reactions were what they were. Why the emotions and actions you saw were what they were. Because he believed that someone in Ayla's family had her. So he wasn't pleading on TV with some murderous stranger. But sadly, that was and is and always has been a possibility. Just not one he would let himself entertain.
@ Selena, not bad. But why would any of those people take Ayla and send her someplace where they cannot see her if their motive was that they wanted to be with her?? I do doubt the theory that Justin is letting LE do their job. Both he and Phoebe have been outspoken of their dislike and distrust of LE, Steve inparticular. People who distrust law enforcement generally don't pin all their hopes and dreams on law enforcement finding the child they love so dearly. Perhaps to cover for someone else... that I will buy. LE said from almost week one they didn't believe he was telling them the entire truth, and I think he is smarter than to trust someone who states rather emphatically that they don't trust him. So I have to go back to asking why he didn't make any attempt to get Ayla from Trista or one of her people at ANY point during this nightmare. I think that is something only he can answer, and that isn't going to happen to this is really a rhetorical question.

Wait, walk me though this... Justin reacted (or didn't react) the way he did because he believed/believes Trista's family had Ayla taken away because they didn't trust her as a mother? And YET, they left little Ray behind to remain in the hands of this horrible person they did not trust? This is not a logical sequence of events. Is this just a theory to look at? I think theories are great and should be explored, however it would appear this was posted to be interpreted as statement of fact, and if this is truly what what Justin is telling you, I am even more apprehensive of his innocence, to be frank. A family so concerned about the well being of children that they would have a child abducted to live with complete strangers would not choose one child to save while leaving another (younger and more vulnerable) behind. If this really is what he's telling you, I urge you to consider the logic in this.

Most people who have had to live in the conditions that Trista and some of her family live, dont trust LE and wouldnt call them for anything. They handle their problems from the hip....they just do and dont think. With this being such an emotional situation...emotions get in the way of thinking stuff through. Pogamen, I'm the one that lost my son, but it was more like an hour that I was aware he was missing until he was found. For my husband it was 90 minutes since he was attempting to get ahold of me & my phone was off. What do you mean by me being a sensitive?

DeleteI thought the similarity was bizarre myself. You know your miracle, but it was someone else that helped you. It is a biggy, glad you asked. There's a huge difference between your story and the other mother's story. The resulting 'peace of mind' is different, too. It's not easy to explain in public. The risk of harming others, when there's no reason, prevents me from telling some things. Sometimes, things happen that can never completely go away, leaving haunted memories, unjustified fears, nightmares. Sometimes the story isn't palatable, even with a happy ending.

I think LE is to concerned with not letting this case go the way Caylee Anthony's and Baby Lisa's did that they have lost all sight in doing a proper investigation. Anon I can ask that question just as anyone else asks Trista to justify why she didn't go get Ayla from JD. I am asking so I can understand what sort of alternative there is, because at present moment I just don't understand how he is so sure Trista took her but has taken no action. And please do not say he's doing a whole bunch behind the scenes as we both know he has not tried to get Ayla from Trista since Ayla was abducted. Statements get made by both sides all the time. Some are less rational than others. I am asking how you are so sure Justin is right, and Trista has Ayla? I'm not trying to argue, I'm trying to get a reasonable explanation. It's easy to say she did but I've seen no actions to support he truly believes that as well. Maybe he doesn't, maybe those are just words spoken on his behalf again.

I imagine he didn't know for sure that she took Ayla, he thought someone in her family did maybe with her knowledge, maybe not. Eventually thought maybe it had been her after all. I see it as a hell of a confusing situation and him not knowing what to think, who to trust, who had been in on it and who hadn't. I see him facing a public that was out to get him from the word go and LE wanting answers from him that he didn't have. And eventually maybe he did give up hope on LE. But that certainly wasn't the case for a long time. All his faith was in them. I don't know that anyone actually thinks Trista has Ayla. I know a lot of people think it's plausible that she meant to keep her, thought Justin would call her and be pissed off and she'd say something to the effect of "too bad, I have her now. A dad may trump an 'Aunt' any day; but Dad doesn't trump 'Mom' any day. I have her now, deal with it. Merry Christmas." But then Justin didn't call, and LE did. and she had to pass her to a close trusted friend or family member until things blew over. In her mind I think she could have believed there was a way to make it blow over. I would never have thought so; but I don't do drugs, don't drink, don't have any mental issues that require several medications. I obey the law and have no (to my knowledge) aquaintences with any criminal records or backgrounds. I live in a nice neighborhood and work hard and earn my money and pay my taxes. I think through decisions that I make. So I would not in any moment have made a lot of the choices that she has made. I think what you're missing--what everyone is missing-- is that it is incredibly ridiculous to discount the plausibility of it. the need to question it. The need to consider it. It's not that people are saying she must have done it. [well, okay, Dale is. But that is just one person.] Others are saying that it's REASONABLE to consider it. And they are giving the reasons that make it clear that Trista has a history of making decisions that are not well thought out. There is no accusation in that. There are not people just trying to "prove Justin's innocence" here. There ARE people saying PLEASE look at the other possibilities because we REALLY want Ayla found.

Derek, true, I would have to be Trista and am not. Kindly read my post again - I was making a point that saying something does not make it true. That said, I am reasonably confident in MY source (which again is only hearsay). Trista didn't turn against Justin until more recently, and the alleged sex act(s) took place prior to the abduction. My point, Mr. T, is that while it's easy to say"why did Trista do this or that" the same can apply you Justin. Why was he sleeping with her if he felt she would "steal" Ayla from him. Why be so nice to her AFTER the abduction if he thought she did it?? If the text messages that were leaked here to be be believed, he was more concerned about his appearance and what Trista's family said about him then he was at accusing Trista of taking Ayla. In my opinion it's a made up theory, probably not made up by Justin. BTW, never doubt the power of shame as a reason to lie.

Good point charlie. I disagree that Justin is concerned more with appearance than accusing trista. Those two things go hand in hand. He doesn't have proof that it was trista; for all he knows, her family might have done this and kept her in the dark (though it's unlikely she wouldn't know to some degree.) Justin doesn't necessarily want what is happening to him to happen for Trista or anybody until they are proven guilty. It's not going to make him "appear better" if he goes out and starts pointing fingers. Thank you for remaining civil.

The definition of polygraph: a test using such an instrument to determine if a person is telling the truth (Source dictionary.com). To fail a polygraph is to be deceptive in your answers asked during the test administered. To be deceptive is to intentionally mislead. To mislead (intentionally or otherwise) if you are Trista means you are a liar. Not so for JD?

The pro Justin faction, represented here and at TTLOM take the stand that Trista is a lying, druggie, trampy, lay-about and therefore must have abducted her daughter. The pro Trista forces at U4A seem to believe that Justin is a lying, druggie, man-whore lay-about and therefore must have harmed his baby. I doubt that many of these issues raised will prove relevant if this case is ever solved.
ReplyDeleteAs to Trista's "lies", taking a look at a few that have been mentioned, there's the "Justin and I had an agreement" versus DHHS took my baby. All I know is that both parents say they had an agreement and both admit DHHS involvement. Then there's Trista's suspicions of abuse versus her saying she thought Ayla was safe with Justin. Inconsistent, yes, illogical to most, yes, but there really isn't any way to prove what Trista thought. Maybe she had her suspicions, but wanted to believe that Ayla was safe. Who really knows? Then there's Trista saying she wasn't informed of what police were going to say before the press conference while McCausland clearly said she had been informed. Maybe she was obediently waiting for the official permission to reveal she'd been informed beforehand. It really doesn't make much sense, sort of like Justin saying LE had asked him not to talk to the press and McCausland subsequently saying he must have misunderstood because LE had urged the families to speak out after the first couple of days of the investigation.
So what of the various statements Trista has made can we believe? She's said that there was DNA evidence of a Portland tryst with Justin still on bedsheets at the Waterville home. And of course, there's the really incriminating statement that more than a cup of Ayla's blood was found at the DiPietro home. These are not statements of feeling or opinion. These are matters of fact, easily refutable, and LE knows whether or not these assertions are true. If these statements are not true, why does LE not say that Trista has not been forthcoming and told all she knows or that she has deliberately misled investigators? Why does LE continue to focus on those present at the DiPietro home when Ayla was reported missing?

That was why Jessica didn't want to wake Trista until enough time went by for Trista to be receptive to Jessica's [needs new words] powers of persuasion. Jessica tested it, used it, and bragged about it to some of her female friends. Trista had to sleep for a certain number of hours for this 'conditioning' to be effective. I, personally, have never, NEVER, heard of such a thing happening to anyone. But it did, and Jessica knew about Trista's short term memory problem (what happened yesterday).

ReplyDeleteIn the next 24 hours before the reward expires: can everyone stop whatever you may be doing and send prayers that whoever has the precious Ayla Bell will return her to where she belongs. This has gone on long enough. This case has divided communities and brought total strangers together and in it all everyone has one common goal and that is to get this baby back safe and sound. It does not matter who you think is involved all that matters is Ayla comes home. It is not a time for fighting and accusations it is a time for prayer. Ayla I hope that once you are home you never have to read the things said during your absence. None of this will matter as long as you are safe and sound. Please know you are loved by so many and we will not give up until you are found. Whoever has her tomorrow is suppose to be a beautiful day, drop Ayla off in a park, a hospital, a fire station and walk away. Then call and let LE know her location. Win win situation you can collect the money and Ayla will be home where she belongs. Please end this now.
