Oh, What a Day!

It's been a long day, and tomorrow will begin a long work week. I'm going to respond here to a few comments, then I must be off to bed! 6 a.m. comes way too soon!

Before I begin, I have to say something about being "anonymous." People are up in arms about who is writing this blog. Other blog owners who chose to reveal their identities were attacked relentlessly and had their background looked into by people who claimed to only want justice for Ayla. It is also hypocritical that MOST of the people complaining about the blog owner being anonymous are posting their concerns ANONYMOUSLY. You do not want your real identity to be associated with your own words, yet you want to hold me to a different standard? You all are constantly trying to figure out who I am, while making statements that I "forgot" about Ayla. Well, every second you devote to finding out who I am, takes away from Ayla as well. Comprende?


I do appreciate your point of view WRT the DHHS angle, 'Anon'.

And, I fully understand DHHS could NOT legally stand in JDiPs WAY, when he decided to excercise his parental rights, taking Ayla from Jessica Reynolds' apt. while Trista was in rehab.

BUT, my question is this:

Why did they get involved in his decision and HELP him take her??
And, after involving themselves in the situation BY HELPING him take Ayla..
WHY didn't they open a case to record their involvment, and then FOLLOW UP by checking on her??

It's one thing to say "DHHS has no authority to STOP" a bio-parent from taking his child to which he is a virtual STRANGER (Ayla kicking & screaming, during the trsf., IIRC!)
And it is ANOTHER THING ENTIRELY to help FACILITATE the man to do so.

That is where I, personally, DO fault DHHS.
If that IS how the system generally works, it REALLY needs to change IMO.

This was a child who was safe where she was, AND, agents of DHHS were instrumental in HANDING HER OVER to a man she barely knew and who was in obvious DISTRESS being given to.
A child not old enough to be explained to, WHERE her mother was, who was being NEEDLESSLY TRAUMATIZED (at minimum) by the hand-over!!

Where was Ayla's BEST INTERESTS being served by this arrangement?
Moreover, once traumatized by being handed over kicking,screaming and TERRIFIED why wasn't JDiP MANDATED BY DHHS to bring Ayla to a child-psychiatrist?? The kid was being obviously TRAUMATIZED.

If this IS how the system generally works, and DHHS followed protocol TO THE LETTER, then I hope Trista Reynolds STILL sues.
Not for monetary damages... but for POLICY CHANGE!!!
In order to say that DHHS took Ayla from the Reynold's family, you have to totally ignore the fact that Trista says she and Justin had an agreement that he would care for Ayla while she was in rehab. Also, it has been stated that DHHS'  role in the situation was to verify to law enforcement that Justin is Ayla's father.

Ayla could have been handed over to Justin with little to none of the "trauma" that you refer to. Jessica Reynolds was notified that she needed to hand Ayla over to Justin, she refused, and her actions are what necessitated police officers handling the exchange the way they did. Jessica Reynolds has already had her own child(ren) removed from her care by DHHS, so I can see why she'd be reluctant to turn over another child.


I hope Trista Reynolds sues as well. It's her right to do so, and I hope that she would be suing to reform the system and not pad her pockets. It would be awesome if she sued so that no other child's case would be handled in the manner she claims Ayla's was. This case makes it clear that DHHS is in need of serious reform, and that law enforcement may want to conduct some sort of refresher training when it comes to diffusing/handling these types of situations.


Here's the thing about "custody". If parents are not married and there is no court order in place, which is often the case, each party has equal rights to the child and can take the child from the other parent at will without committing a crime. The fact that DHS was involved in this does not mean they placed Ayla with Justin but rather did not stand in the way of a biological father exercising his right, over that of extended family, to care for his child while mom is in rehab. The fact that Trista's other child was not removed shows us that this was not a case where DHS could prove jeopardy to the child but rather facilitated what was supposed to be a safe mutual agreement between the parents. Not uncommon and none of it means anyone lied...they just didnt have a very sophisticated understanding of "the system". Given Trista's problems and those of her sons father, it isn't surprising that DHS was watching. Doesn't mean they had a court order of any kind....or that anyone did.

These are  very good points, and this is  well said. The big part of the custody situation that I cannot understand is why the baby boy was not removed. Either both children were safe, or both were unsafe. It makes it look more like Ayla going to Justin was indeed an agreement between parents. Did Trista's family try to change her decision to let Ayla go with Justin? Were they unhappy with that arrangement, and trying to stop it from happening?

  1. You practically answered your own question. Ayla was not removed for cause. She was taken by her father who had a right to take her, with or without an agreement with the mother. Ignore his getting assistance from police and DHHS. He enforced his parental rights. He couldn't take the little boy because that's not his kid. DHHS had no reason to, they were not there looking into a problem with either child's placement; they had apparently decided it was fine for the kids to stay with Grandma and aunt while Trista got treatment. And it would have remained fine if Justin hadn't decided to step in and take Ayla. There was no "removal" in the legal sense, only the physical sense. The removal was not about safety. It was about a father asserting rights while the mother was vulnerable. The "agreement" that Justin would watch Ayla while Trista was in treatment occurred two days later, after Justin already had Ayla.

    2. If there was no removal in a legal sense, how in the world would a lawsuit be levied against DHHS? Seems like the DiPietros would be the only parties she would be able to sue...

      I wonder how Justin knew Trista was going to rehab.

      Trista demanded that he move back in with Phoebe... if the agreement occurred after he already had her it doesn't seem like he would have to change anything, but he did.

      Also, if there was no legal removal, why was there a family team meeting?

    3. Family team meetings are routine, even when no removal happens, so that everyone can get their wishes for the child heard. I don't know this, but Trista may have made her agreement to engage in this brief arrangement with Justin contingent upon him staying at his mothers. Again, not unusual.

      And anyone can file a lawsuit for anything.

      Also, seems like, and I may be wrong, that there was some contact between the parents around the time she went to rehab, the was visitation etc. If not, he may have heard it from mutual acquaintances.

    5. So Justin DiPietro is so special that he doesn't have to go to court for parental/custodial issues? Either dhhs or LE got involved where they shouldn't have.
      Obviously, by the time he filed and got a court date she would have been long done with detox, so WHO expedited this "custody" process? Dhhs? LE? Or is Justin just that special? Did he file a complaint the Ayla was being held hostage or kidnapped by Trista's mother or sister? Would LE have helped remove Ayla from a certified daycare facility and hand her over to Justin? Something doesn't make sense.

    6. Anon 7:49, not so. Details come from Trista's timeline and news reports. I do happen to understand how the law works, so that helps me interpret what's going on.

      Trista's timeline says Justin was fine with Jessica keeping Ayla at first- implying either Trista or someone on her behalf told him- but then reversed course and took Ayla a few days later.

There has never been a public statement or public information that the agreement between Trista and Justin that Justin could have Ayla during the rehab came two days AFTER Justin took Ayla. So either you made this up, or you have inside information.

    8. Trista said early on she told Justin he could care for Ayla if he moved back in with his mother. Later she came up with the wild tale that DHHS violated her rights. IMO she made that agreement with Justin against (or without) the approval of the aunt and Grams. Now she's trying to play victim of the system.

      I also don't for one second believe there were ever ANY reports made on concerns over Ayla while in Justin's care, because that would/should have been front and center at the family meeting. Trista states it was agreed in writing she would get Ayla back after she was released. Why then (with those concerns)didn't she bother to make the trip (papers in hand and LE at her side) to Waterville and get Ayla back? But no, she gets tired of being stone-walled by LE and says OK you keep her, just bring her for visits.

      And even again another chance to get Ayla, why didn't she show up at the Drs appt. with those papers in hand (escorted again by LE) and say she is suppose to be with ME!

      Because LE does not escort/get involved with CUSTODY issues. Unless your name is Justin DiPietro, I guess. OR unless a child is in immediate danger, then they would get involved and involve dhs. But, that is obviously not the case, becsuse the other baby would have been REMOVED also.
      So, either dhs got "involved" and decided to uninvolve themselves and/or LE got involved in something they had no right to.
      Trista should sue dhs, LE, the dr who didn't report Ayla's arm and anyone else who failed to protect Ayla, while she was in her daddy's CUSTODY (his word).

    1. Sara most of us have seen Trista's various interviews and one of the early ones was her stating she told Justin he could take Ayla if he moved back to his mothers, because she thought it would have been the safest place for her.

      To say that an agreement came after she was in detox really doesn't offer much value to the "concerns" Trista and the family supposedly had on how Ayla was being cared for during previous times she spent with Justin.

You want to remain anonymous... not because you fear that readers will attack you relentlessly but because your identity will in fact prove you are jealous of Trista and that your agenda is not in fact finding baby Ayla, but deflecting the truth that Justin is a murderer. You have gone as far as to put physical distance between you and the Dips by stating you live in Texas. Four times now you have deleted my post that would prove you are in Texas which is really odd being that it is so very important to you that we all know that. Again, post a photograph of your television showing your weather news. Can't do it, can you? Instead, you will delete this post as you have the 100s of post that scream you are a hoax and liar before this post.

  4. My point is:

    Whether or NOT the DHHS workers were involved in handing Ayla over to her father for "safety" reasons vs. "court ordered custody change"... they WERE involved!

    Once DHHS was involved with Ayla's change in living situation, and especially considering the traumatic nature of the hand-over, they SHOULD have been required to check up on her!

    It's insane for DHHS to now claim they "weren't involved" in the situation that landed Ayla in the DiPietro household.
    That is *beyond* unethical!

    DHHS officials in conjunction with LE facilitated the hand-over of Ayla to Justin.

    They should not have been able to brush their hands off and say "all done, no longer a DHHS problem", the moment Justin had Ayla buckled into her carseat!

      I suggest we all go to the top of the page and click the "report abuse" tab next to the search bar and the button which allows you to follow this blog. This blog goes against blogger.com's terms of service with its hate, slander, and libel. If enough people report it maybe blogger.com will close it down for good.

  6. I think there is more to this DHHS involvement than what Trista has disclosed. Trista has been very evasive about DHHS and the custody. On the Today Show, they tried to pin her down on this, and she said Ayla was taken due to BOTH an agreement with Justin and DHHS. Very confusing.

    I can't figure out what went on with the custody. But one thing I know for sure is that Trista is very, very good at giving evasive answers and getting away with it. She comes across as stupid, so interviewers back off thinking she is incapable of explaining herself. But Trista gives unclear answers, not because she is stupid, but because she is cunning.

  7. What struck me right at the beginning of this case was that the first picture released by Trista of Ayla had Ayla's face concealed by very large sunglasses. I thought that was very odd, as if she did not want the public to be able to identify Ayla.

    At first I tried to justify it in my own mind, thinking that maybe Trista did not have other better pictures showing Ayla's face. But that turned out not to be accurate. Trista had lots of pictures of Ayla, but chose the picture that concealed Ayla's face FOR A REASON.

    Trista or someone associated with her then had tee shirts made up with a picture on the front of Ayla, again selecting the photo that concealed Ayla's face. Once again, getting me wondering just how cunning this Trista might be.

    2. I agree that this is a fair observation. If God forbid, my kid was ever missing I would not be making T-shirts with a picture of my child wearing sunglasses so that people who see it would not even see a complete picture of my child's face or the color of their eyes--which is pretty important when trying to identify a 2 yr. old. It is an odd thing to do. I don't think pointing that out means that this person is Angela.

    3. bobby- I had the exact same questions about the T-shirts. Many of us that are following the case asked about it. Would love to have an explanation...but I'm not sure an explanation now would convince me of anything. It's a flag.

Oh for goodness sake, will you guys please get off the DHHS issue, whether Trista is stupid or her looks, whether Courtney or other girls are jealous, etc. This is just good clean fill that has nothing to do with Ayla missing or being found. Common sense (which apparently some of you lack) tells us nobody in their right mind could be jealous of Trista. Jealous of what?

    I believe Selena is sincere and she believes her family is innocent. I hope they are and I want to believe it, but I have to admit that the until more details are released by somebody, suspicion points to someone in that family or circle of friends.

    I do think that Justin or any family member coming forward to talk will result in more bashing of them, but I also think that is what they should do. Why not allow themselves to be interviewed by a respected media person (that would exclude Nancy Grace and those similar)? There is no way to get trapped in a lie if you aren't lying. If Justin doesn't want to come forward and talk because of his personality quirks, then why doesn't Elisha come forward?

    For the family to continue in silence will never lift the cloud of suspicion that points to them. If they can live with that, good for them because I sure could not.

You CREEPS can keep trying to pass the blame, or guilt, or spotlight to Trista, but it is obvious that Trista loves Ayla and cared for her very well AND went willingly to detox to better her childrens lives. It is also obvious that she (naively) THOUGHT her daughter was safe with Justin, and when she realized her daughter was NOT safe and something odd was happening, it was too late.
    The comment about the picture of Ayla with sunglasses. Please! You people are really brain dead.
    Where are the pictures from Justin? The unedited ones, that is?!

  13. Although Trista has made some less than stellar life choices, I don't really see any reason to suspect her in Ayla's disappearance. If she had been anywhere near that house on the night in question, the police would know that by now.

    And, this appears to have been just an informal, temporary arrangement. Trista didn't NEED to snatch Ayla. She could have went to that house at any time and taken her back legally.

    I'm left to assume that the parent who's keeping the child's name and photo in the news (and on the web) is the one seriously looking for her and wanting her back. The silence of the other parent speaks volumes to me.

    1. Maybe the police do know that. And maybe Trista did think she was doing it legally. Taking your own child is not actually kidnapping. So maybe she just thought Justin would be angry and call her and say I know you took her! Give her back! Maybe she did not think it would result in him even calling the police. And this all just blew out of her control before she knew it. And I am sorry but the one who is keeping the child's name in the news is also the one who keeps implying she is not even alive. And that she just wants closure. How is that the parent who wants her back? Perhaps someone would like the public to give up so that they can just disappear?

Anon @ 9:55 am--I'm not saying that Trista took Ayla, I'm just saying that it is odd to choose a picture of your kid where her eye color and part of her face is concealed to help people know what she looks like. Ask yourself--would you do that? What about police sketch artists who sketch a picture of what a missing child might look like years after they went missing--age advancement--to help people recognize the missing child if they see them. Would they do the age advancement sketch and then draw large sunglasses on the face? At the very least, it shows a real lack of common sense. It is fair for someone to point it out.

  15. You people can't even have an intelligent coherent thought, in trying to blame Trista and take the attention off the DiPietro's, their friends and family. Wow! So, where is Trista so brilliantly hiding Ayla? Or, do you sick, nasty people think she murdered her own daughter too?? Do you not think that possibility was fully investigated? You think she has been outsmarting LE for over 2 months now? She or someone she knows snuck in and kidnapped Ayla, so perfectly that they left not one piece of evidence along the way, yet there ARE hundreds of pieces of evidence that was collected from 29 Violette Ave, non of which appear point to abduction/kidnapping.
    The sunglasses thing was old before you even made a comment, it is feeble, feeble minded and proves your concern of the truth being uncovered - one of those truths is SOMEONE needed to edit/airbrush a (normally appearing) perfect, healthy, clean happy baby. That's pretty pathetic. Where are all the great UNedited pictures of Ayla from Justin? Oh, that's right, there are none (that the public has seen). Is he hiding those too, like he's hiding himself? Are they top secret? Did LE order him to not provide any decent, unedited photo's of Ayla?

    2. It is a huge leap to assume that it has not been looked in to just because it has not been released. Unfortunately, for those of us following the case and praying for answers, law enforcement is not required to share information with us and seems to be very deliberate and careful in releasing any information. I don't think we can assume that because we haven't heard it, it hasn't been investigated.
