Lack of Investigation?
Would it not be easier to verify the circumstances of the broken arm on the
first day than it would be to determine the circumstances of an alleged or
supposed abduction? The broken arm story could be verified through medical
records, doctor’s reports, stories from the parents and others with knowledge
of the incident (given either at the time the injury happened or after), and
potentially DHHS records. On the other hand, to rule out (or in) an abduction could
entail crime scene processing and analysis, lie detector tests,
interrogations/interviews, soliciting tips, and other law enforcement procedures and methods.
The information gained from the latter does not necessarily change the record
with regard to the broken arm. The police official did not say “we asked Justin
what happened, and we believed him.” He said we conducted extensive interviews.
Do you think he is lying? Do you think he has any reason to mislead you about
the broken arm? Criminal investigations are, as you said, dynamic. Determining whether or not an arm was broken in an accidental fall is not. From law enforcement's statement on day 1, we should be drawing the conclusion that the broken arm is not a part of the criminal investigation. Again, why are you willing to believe certain police statements, while dismissing the ones that don’t fit into your theory? I understand that the totality of circumstances has to be considered, but until police retract their statement and say the broken arm was not an accident, we should consider that matter resolved for purposes of speculation.
Rain and The Fall
I keep seeing the lack of rainfall and the date of the Justin’s last class
used to assert that either the accident did not happen as he said it did, or
that it happened before he said it did. What would compel Justin to all of a sudden seek medical treatment after waiting that long? Child abusers usually do not get treatment at all in order to avoid detection, or when they do bring the child in it is obvious that the injury is not recent. Furthermore, old injuries may be detected while the "new" ones are examined. Trista and the Reynold’s family have been very vocal in this case, and I cannot help but notice that they have not disputed the rainfall aspect of Justin's story. Don't you think Waterville PD at least has the resources to figure out on what days it rained? Wouldn't the doctor at the emergency room, who was likely told the same story, know whether or not it rained the previous night? (I say the same story was likely told, because the police said they did extensive interviews before ruling the fall as accidental.)
It has been mentioned the fall happened up two or three small steps and that the DiPietros delayed seeking medical attention. I am by no means making excuses for the story given by Justin, but none of us are privy to any information that contradicts it. His last class date could have been changed due to earlier cancellations, absences, or the need to complete driving time. We also know that Ayla was seen on Halloween by at least one person not related to the DiPietro family, and it would seem simple enough to verify with this person whether or not Ayla’s arm was already broken or seemingly hurting her at that time.
The last thing to consider, is that Trista could have her own dates wrong, and that’s the only information you have drawn your conclusions from. Justin says the incident occurred on a rainy night in November. Well, there were a few rainy nights in November.
Neighbors
You reported that one neighbor was unaware of Ayla’s existence; she didn’t
know Ayla was there or that Justin even had a daughter. It’s important to point
out that another neighbor, one who lived next door and could see into Ayla’s
bedroom, did recall seeing the toddler. It was rather lopsided of you to
include one account in your “story” while ignoring the other. A simple search
performed on Google using the terms “Ayla Reynolds neighbor” brings up
information about both witnesses.
Initial Suspicions
The doctor should very well have been suspicious of abuse initially, because broken bones in children are very often associated with abuse. Any
time a child that young is seen for a broken arm, abuse has to be considered
and ruled out. Doctors are also mandated reporters, and that particular doctor
would be risking his/her license and open the door for a lawsuit if he/she
failed to report suspected abuse. You are asking for information revealed after
the fact to be considered in determining whether or not Ayla’s bone was broken
accidentally. Trista's timeline indicates that Ayla had a left forearm fracture, which is the most common fracture seen in children. The fracture frequently occurs when a child tries to break a fall with outstretched arms. Justin falling on top of her would add even more pressure to her little arms. Makes sense to me...and it obviously made sense to the treating physician. For those of you who question whether or not the break was accidental, don't you think there would be bruising or some other sign of direct trauma if Justin caused the injury with intent?
Implications
Child abuse charges could be a potential outcome, but the new “evidence”
(life insurance) will probably not be used to determine whether or not the arm break was
an accident. Life insurance policies, unfortunately, do not show up on x-rays.
The doctor, and the bone specialist that Ayla saw on November 21st,
are supposed to possess the experience and knowledge to determine whether or
not the trajectory of a fall could plausibly result in the injury presented. If
you are further trying to say that Ayla’s broken arm would result in other
children being removed from the home, that’s another one of your logical
fallacies.
Wrap Up
Not only are you questioning the judgment of the police department, you are
also questioning the judgment of the medical doctor(s) responsible for Ayla’s
care. Let’s also not forget that you know absolutely NO details about the life
insurance policy. Trista Reynolds says "In the same week Justin took Ayla from me, he took out a life insurance policy on Ayla." That does not really narrow down a date.As far as I’m concerned, the date the policy was written and the amount of the policy are pure speculation. If it turns out that the policy was taken out after the broken arm, then your whole theory falls to pieces.
You don’t know the terms of the policy; perhaps a certain number of payments would have to be made before one could collect a payout. I’m almost sure that it would prevent a murderer from collecting. With no body, the policy may lay out specific procedures. I don’t know those details either, and that’s one of the reasons why the life insurance remains a non-factor for me at this point. Don't hold your breath until law enforcement officially stamps "case closed" on the broken arm issue, because they have already said it was an accidental fall.
Police are investigating her disappearance. Not child abuse. Not a broken arm. They are trying to FIND AYLA.
To expand on my own curiosity about the insurance policy....It pretty suspect that Justin would go purchase life insurance for his toddler when he didn't have a job. I can understand adding a child to a group policy of an employed parent but not going out to buy insurance specifically for her.

This blog analysis misses important points. The biggest is that the doctor's first instinct was to think the broken arm resulted from abuse. And that instinct now looks to be the truth, though it isn't proven at this point.
ReplyDeleteWhen children are murdered, police often go back and look at past injuries and events that were thought to be accidental and find evidence that they were not. (Think SIDS cases, for example). The public doesn't have the x-ray or medical reports, but from what has been said publicly it must leave room for an interpretation of abuse or not abuse. Otherwise the dr. originally wouldn't have said anything to them about the injury being suspicious. Now what would make a doctor say it's one v. the other? The parent's explanation, in part. And when the parent later turns out to be 1. a proven liar, 2. a man who took out a life ins. policy on a baby he barely knew and was only taking care of til her mother got out of treatment, and 3. very important- was responsible for the baby when other recent injuries happened to her and told preposterous stories of how she got them, then it looks like something both police and the doctor would now look at differently than they did before these facts came out.
Why would he get treatment after waiting so long if the injury happened earlier? Hard to say. Maybe it's the first time he had her in W'ville since the injury- maybe it happened in Portland- and maybe Grandma saw it and told him to get her to the ER. Maybe he didn't wait a long time. Maybe he just lied about it being a rainy night before the last day of his class, but if he lied about this he must have had a motive. What would that be?
All good points, but a person could be all of the above and still not have abused their child and caused the fracture. So the way I see it, the doctor made the determination off of the available history and injury as well as medical reports. Any time a child has a broken bone, especially a child that young, ALL doctors should initially suspect abuse IMO.

She didnt know that it was broken.(The school NURSE) He sat on my couch for awhile and then it started swelling. I took him in.I was told by the ER Doc that every health provider is to suspect abuse first.Rule stuff out.Make that decision.Of course he would say that...they all have to.....all health care providers do this for minors.

DeleteI'd hate to to end up broken, bloody knee caps for saying something I didn't know I wasn't supposed to say. Well, I guess that's a little dramatic; it was only a toy bat, so, I guess it's more intellectually honest to say, I wouldn't want to end up with little bruises on my knees.
Oh, and I didn't know Justin was a cheerleader. Not that I'm saying anything is wrong with a guy being a cheerleader. I think that's pretty cool! I have a much more positive impression of him now. In fact, I'm certain now that he has never done anything criminal in his whole life! Poor Justin. Why must all these evil people pick on him? He's just a sensitive young man who has no "idea" what happened to his baby daughter who was in his "sole" custody when she went missing.

Everyone says that their is NO way that someone came in the house at night without being heard,
I would assume that people came and went in the house at different times, and perhaps late in the evenings early AM's I have 2 young adult sons, they come and go as they please. It has hardened my sleep habits, i dont hear them all the time, and if I do hear them I dont pay much attention, as I assume its just them coming home.
I still beleive that Ayla is deceased, and that this occured in the home, by one of the 3 adults. I believe there was NO kidnapping. I "feel" that Ayla was DUMPED in portland, and a kidnapping was staged in Waterville to deter the police from finding her.
I just wanted to post that those that say there is NO way that someone could have came in without being heard is not "concrete", especially if late night comings and goings are common.
There recently 2 cases of kids getting up during the night and leaving their homes without the parents hearing anything at all. One was a 3 y/o girl who then walked about a mile (IIRC) in the snow to a store where she thought her mother was. We can assume this girl wasn't trying to be "sneaky quiet" like a person would be breaking into a home.
DeleteI also agree that having several people in one home you wouldn't wake up to every little sound because hearing a door or something you would assume it was another adult in the home. Or a person might not even wake up at all, or just slightly but not enough to question what they heard.
Last time I checked, people don't usually get payouts from insurance companies on broken or fractured bones.
ReplyDeleteWhether the policy was taken before or after this incident isn't really relevant though, and shouldn't even be connected to a broken bone. If it was taken out before, as some kind of build up to a pay out, they'd be SOL. If it was taken out after, then it's not relevant regardless because the payout wouldn't cover it anyway.
If it's life insurance, so be it, but I wondered though if perhaps somebody got it wrong and it was medical/life - at which point most of the accusations against the guy would implode. If she got hurt and he was suddenly facing some hefty ER bills, that easily could motivate the guy to look into medical/life - as a combo package, which isn't uncommon either. If it was before the incident, it looks even better and more conscientious for him as a caring, thoughtful parent making responsible decisions.
I guess, unless I missed something in all this - though I am still learning the details so may be - it looks like Justin didn't know he had a child until the firebug got busted and Trista went on welfare...and then in order to not lose both her kids (or however many she has), she has to go to rehab...so she calls up Justin and they seem to have had a rather civil discussion about it, she is agreeable to letting Ayla go with him. Paternity seems to have been formally established at some point, else he never would've been able to take custody in any legal sense and child services would definitely not facilitate it. So this is all coming up over the course of a couple months between him learning he has a child and taking her over, and then her disappearance? I may be inaccurate on that but haven't studied any timelines, just pieces.
IF so, I can't see the guy just finding out he has a daughter, or that her daughter was always his, whichever, them talking and him stepping up to take care of the little girl, and being willing to seek custody or a more legal order about it JUST so he can turn around a month or so later and kill the kid for insurance money. I don't buy that for a shred of a second...and neither does anyone else who is rational.
If he didn't want the responsibility, he could've just said nope, you handle it and waited on her to file for child support or whatever. He seemed to step up, take on the responsibility and seemed to make choices that were responsible - that's a pattern of behavior that seems to be dismissed. He may have been a stoner or had unsavory friends, may have quit working and went to live with his mother - for a support structure as a lot of younger parents do. Getting insurance doesn't look suspect at all. It looks responsible.
How many of these "anons" on here with kids have insurance? I bet 1% if that.
There's the incident with the fall and broken arm. They didn't take her to the ER. If there wasn't any overt sign of a break, I can see where they didn't think it'd been broken, didn't look broken, (we eyeball it and make a wager, basically - same as that nurse up there), so they figure it'd be okay and while it probably hurts, it wasn't a visibly bad injury. They get another day in and see she's still in pain, still having problems so they take her in. That's not uncommon either.

ReplyDeleteHere's where I'm having issues with the story - why is Trista going on about her suspicions Justin abused the girl or did something, etc. NOW but she's the one who originally had a pow wow with him to let the girl go to begin with? She obviously trusted him, she's clearly stated that she didn't suspect he'd done anything, she turned to him to begin with. Only after the media clownshow kicks in does she start shifting her comments to be more accusatory of him...and now she's talking about all these signs of abuse she never mentioned before.
Seems like she lets other people do her thinking for her and goes where they point. Maybe that's her being unstable due to the drugs but it doesn't do a lot for her credibility if Nancy Grace wigs out about Justin's suspicious behavior and suddenly Trista's all about Yeah, you know...you're right, he IS suspicious...and you know what else, there's all these signs of abuse!!!
If that was true and she was a competent mother, she never would've allowed her child to go with the guy when she had zero relationship with him. Otherwise she pawned the girl off on a stranger - nevermind paternity - and that means she's highly irresponsible.
Where is the actual evidence of all these signs of abuse? And more importantly, where is the evidence this abuse was de facto inflicted by Justin?
Not siding with either of them, just asking questions for clarification.
One more before I make it to the next one (good site, definitely sucking me right in)...
ReplyDeleteI'm asking for clarification for this too - and again, I'm not at all boned up on the timeline, just went off the previous entry on the firebug and Justin learning about having a child - specifics on that would be appreciated, but it read to me that only a few months at best lapsed between his even learning he had a kid and her disappearance, with the hand off happening shortly before. If that's correct, I can't see him doing anything to her.
Is there anything that definitely or clearly proves this is not the case: He learns he has a kid, he's psyched about it, he already knew Trista had issues - drug and mental (she's got something wrong with her, sorry) and decided to step in, only he realized how screwed up her life was and her history and recognized Ayla would be in greater risk with Trista, so he approached the idea of keeping her full time, Trista understandably protested, so he realizes he'll have a big fight, but without more legal ground, he decided to play "keep away" - the child's fine, he's got her stashed somewhere and isn't prepared (so far) to hand her over, plus he'd be up s creek by now. Is there anything that shows this isn't what happened or isn't a realistic possibility?
If I thought my ex was a high risk, I'd risk jail to make sure he didn't get anywhere near my child, and if I felt this but also felt the state wouldn't be on my side (maybe to his way of thinking, courts always side with the mother, he'd have no rights, etc), I'd absolutely break the law to protect my child from a parent who would endanger my kids. In a heartbeat.
PS If that was any substantial amount of blood they found, that's just cause and all three of them could've been hauled in over it. That they've kept that on the sly suggests to me it's not a quantity that suggests foul play else they could use that in lieu of a body and call it homicide out loud, and they'd have made some arrests by now. Seems it wasn't that much they could prove any sort of foul play as opposed to general childhood injury.
